1. User Accounts

When you create an account with us, you represent that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

We reserve the right to refuse service, terminate accounts, remove, or edit content, or cancel orders in our sole discretion.

2. Communications and Authorizations

When you are creating an Account on our Service, if you select the option, to receive emailing and newsletter and marketing content or promotional material, we will add you to our mailing list for newsletters, marketing or promotional materials and other information we may send. You may opt out of receiving any, or all, of these communications from us by contacting us at contact@citizenartistskids.com or following the unsubscribe link or instructions provided in any email we send.

You represent and warrant that: (i) you have the right to enter into a binding agreement and, if you are entering into an agreement with us on behalf of an entity, that you are authorized to bind such entity in legal obligations; (ii) if you make a payment to us – that you have the legal right to use any credit card(s) or other payment method(s) that you use to pay us; and that (iii) the information you supply to us is true, correct and complete.

We reserve the right to refuse or cancel your order at any time, for reasons including but not limited to cases where we suspect fraud or an unauthorized or illegal transaction.

3. Subscription Auto-Renewals and Payment

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). The exact amount is set forth in our pricing. Billing cycles are set either on a quarterly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Citizen Artists Kids Ltd cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting Citizen Artists Kids Ltd customer support team.

Only the gift subscription is not subject to an auto-renewals subscription.

A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide Citizen Artists Kids Ltd with accurate and complete billing information including full name, email address, and a valid payment method information. By submitting such payment information, you authorize Citizen Artists Kids Ltd to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, Citizen Artists Kids will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

4. Free Trial

Citizen Artists Kids Ltd may, at its sole discretion, offers a Subscription with a free trial for a limited period ("Free Trial").

​

You may be required to enter your billing information to sign up for the Free Trial. If you do enter your billing information when signing up for the Free Trial, you will not be charged by Citizen Artists Kids until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.

At any time and without notice, Citizen Artists Kids reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.

5. Fee Changes

Citizen Artists Kids Ltd, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

Citizen Artists Kids Ltd will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

6. Refunds

Certain refund requests for Subscriptions may be considered by Citizen Artists Kids Ltd on a case-by-case basis and granted in sole discretion of Citizen Artists Kids Ltd.

7. Our Content

Content uploaded to the Services by or on behalf of Citizen Artists Kids Ltd is the property of Citizen Artists Kids Ltd or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

8. Feedback and Suggestions

If you provide us with any suggestions, comments or other feedback relating to the Citizen Artists kids ltd Services (whether existing, suggested or contemplated), which is or may be subject to any Intellectual Property rights (“Feedback”), such Feedback shall be exclusively owned by Citizen Artists kids Ltd. By providing such Feedback to Citizen Artists Kids ltd. You acknowledge and agree that it may be used by Citizen Artists kids Ltd in order to: (i) further develop, customize and improve of the Services, (ii) provide ongoing assistance and technical support, (iii) contact you with general or personalized Citizen Artists kids Ltd -related notices and/or interview requests based on your feedback or otherwise, (iv) facilitate, sponsor and offer certain promotions, and monitor performance, (v) to create aggregated statistical data and other aggregated and/or inferred information, which Citizen Artists Kids Ltd may use to provide and improve its services, (vi) to enhance Citizen Artists Kids Ltd data security and fraud prevention capabilities, and (vii) to comply with any applicable laws and regulations. In addition, you (1) represent and warrant that such Feedback is accurate, complete, and does not infringe on any third-party rights; (2) irrevocably assign to Citizen Artists Kids Ltd any right, title, and interest you may have in such Feedback and (3) explicitly and irrevocably waive any and all claims relating to any past, present or future moral rights, artists’ rights, or any other similar rights worldwide in or to such Feedback.

9. Intellectual Property

The Service and its original content (excluding Content provided by users, features and functionality are and will remain the exclusive property of Citizen Artists Kids Ltd and its licensors. The Service is protected by copyright.

10Availability, Errors, and Inaccuracies

We are constantly updating product and service offerings on the Service. We cannot guarantee the accuracy or completeness of any information found on the Service.

We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time.

Our Service may contain services that are not owned or controlled by Citizen Artists Kids Ltd.

Citizen Artists Kids Ltd has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that Citizen Artists Kids Ltd shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services.

12. Cancellation

12.1. Cancellation by User

You may discontinue to use and request to cancel your User Account in accordance with the instructions available on the Citizen Artists Kids Ltd Services. The effective date and time for such cancellation shall be the date and time on which you have completed the cancellation process on the Citizen Artists Kids Services, and the effective date for cancellation of Paid Services shall be at the end of such Paid Services’ subscription period.

Notwithstanding anything to the contrary in the foregoing, with respect to subscriptions to Renewing Paid Services, such subscription will be discontinued only upon the expiration of the respective period for which you have already made payment. Please note that as the cancellation process may take a few days, in order to avoid the next automatic renewal and respective charge the cancellation request should be made at least fourteen (14) days prior to the expiration of the then-current service period.

12.2 Cancellation by Citizen Artists Kids Ltd

We may terminate or suspend your account to the Service immediately, without prior notice or liability, in our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

13. Disclaimer of warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Citizen Artists Kids Ltd do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

14. Limitation of Liability

To the fullest extent permitted by law in each applicable jurisdiction, Citizen Artists kids Ltd, its officers, directors, shall not be liable to you for any direct, indirect, incidental, special, punitive, exemplary or consequential damages whatsoever, including any damages resulting from (1) errors, mistakes, or inaccuracies of or in any content; (2) any personal injury or property damage related to your use of the Citizen Artists Kids Ltd Services; (3) any unauthorized access to or use of our servers and/or any personal information and/or other information stored therein; (4) any interruption or cessation of transmission to or from the Citizen Artists kids Ltd Services; (5) the use or display of any Content or User Content posted, emailed, transmitted, or otherwise made available via the Citizen Artists Kids Ltd Services; (6) events beyond the reasonable control of Citizen Artists kids Ltd, including any internet failures, equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, earthquakes, explosions, acts of God, war, terrorism, intergalactic struggles, governmental actions, orders of courts, agencies or tribunals or non-performance of third parties; and/or (7) loss of use, data, profits, goodwill, or other intangible losses, resulting from the use or the inability to use any or all of Citizen Artists Kids Services.

You acknowledge and agree that these limitations of liability are agreed allocations of risk constituting in part the consideration for Citizen Artists kids’ services to you, and such limitations will apply even if Citizen Artists kids has been advised of the possibility of such liabilities.

15. Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

16. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the English law.

These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

18. Severability & Waivers

If any provision of the Citizen Artists Kids Ltd Terms is deemed by a court of competent jurisdiction to be invalid, unlawful, void, or for any reason unenforceable, then such provision shall be deemed severable and will not affect the validity and enforceability of the remaining provisions. No Waiver of any breach or default of any of the Citizen Artists Kids Ltd Terms shall be deemed to be a waiver of any preceding or subsequent breach or default.
